Draft. The final version will be posted before the App Store launch.
Dayfive is run by The Ogawa Group LLC ("Dayfive", "we", "us") in Philadelphia, Pennsylvania. By creating an account or using Dayfive, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Dayfive.
You must be at least 18 years old and able to enter a binding contract.
You must not have been convicted of a felony involving violence or a sexual offense, and you must not be required to register as a sex offender anywhere.
You may have only one account. The information on your profile must be true and about you, and your photos must be of you.
Dayfive opens city by city. You can join the waitlist from anywhere, but you can only match in a city that is open.
When two people like each other, they match and get 5 days to book a date at a public spot. If no date is booked in time, the match ends.
Dates are at public places we suggest, such as cafes, bars, restaurants and parks. When you arrive, you tap "I'm here" to check in.
Your show-up score counts the dates you showed up to. Missing a booked date, or cancelling too close to the start time, is a strike. Reaching the strike limit (currently 3) pauses your account. Strikes fade over time if you keep showing up.
Badges are earned by how you date, for example showing up, being on time, and what your dates privately tell us afterward. Your answers about your dates are never shown to them.
You can unmatch at any time with no strike. If a date is booked, cancel it first.
Creating a profile, matching and chatting are free.
Dates are free during the Philadelphia pilot. Later, we may charge a small date fee. If we do, it will be shown before you book, split between both people, and charged only when you both check in. If you are stood up, you pay nothing and get a free date credit.
We may also offer optional paid features. Prices will be shown before you buy. Purchases made through the App Store or Google Play follow their payment and refund terms.
We do not run criminal background checks or check members' identities. During the pilot a person reviews each profile by hand, and members can take an optional selfie check.
A Verified badge only means the member's selfie matched their profile photos when we checked. It does not confirm who they are or how they will behave.
You are responsible for your own safety. Meet in public, tell a friend where you are going, arrange your own way home, never send money to someone you met on Dayfive, and leave if you feel uncomfortable. In an emergency, call 911.
Please report anyone who makes you feel unsafe. You can report or block from any match.
Dayfive has zero tolerance for objectionable content and abusive users. You agree not to:
You own the photos, video and words you add to Dayfive. You give us a worldwide, non-exclusive, royalty-free license to host, store, display, resize and show them to other members so we can run Dayfive. This license ends when you delete the content or your account, except for copies in backups for a short time.
You confirm you have the right to post everything you add, and that it follows these Terms.
The spots we suggest are independent businesses. We do not own or run them, and we are not responsible for them or for what happens there.
"Reserve a table" opens OpenTable, Resy or the spot's own website, under their own terms.
Some spots may be Dayfive partners that pay us or offer members a perk. We label partner spots.
We review reports and may warn, pause or remove any profile or account, and stop someone from returning, if we believe they broke these Terms or put others at risk. This includes behavior off the app.
If you think we made a mistake, email mark@joindayfive.com.
You can delete your account at any time in the app: Profile, then Delete my account. See our Privacy Policy for what is deleted and what we keep.
We may also close accounts that break these Terms, or stop offering Dayfive in a city or entirely.
Dayfive is provided "as is" and "as available". We do not promise matches, dates, relationships, or that Dayfive will always work without errors.
We are not responsible for how members behave, on or off the app.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for anything that happens between members.
Our total liability to you for any claim is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.
Some places do not allow these limits, so they may not all apply to you.
You agree to cover our losses and costs (including reasonable legal fees) if a claim is made against us because of your content, your conduct, or your breaking these Terms.
If you have a problem with Dayfive, please email mark@joindayfive.com first so we can try to fix it.
These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any dispute will be handled in the state or federal courts in Philadelphia County, Pennsylvania.
If you got Dayfive from the App Store, these Terms are between you and us, not Apple. Apple is not responsible for Dayfive or its support, and has no warranty obligation for it beyond refunding the purchase price, if any. Apple and its subsidiaries may enforce these Terms against you.
We may update these Terms. If a change is important, we will tell you in the app or by email before it takes effect. Using Dayfive after that means you accept the new Terms.
